AssisMonter - Companion Care Technology Platform

AssisMonter is NOT a healthcare provider, medical service, medical transportation provider (NEMT), or caregiver service. Personal Assistants provide COMPANIONSHIP and LIGHT ASSISTANCE ONLY. They do NOT provide medical care, medical advice, physical mobility assistance, or hands-on personal care.

1. Service Overview

Welcome to AssisMonter, a companion care technology platform connecting customers with verified Personal Assistants who provide companionship and non-medical personal assistance during everyday activities.

Personal Assistants may accompany customers during shopping, appointments, airport trips, errands, and daily tasks. Personal Assistants provide their own transportation as independent contractors.

WHAT WE ARE:

A technology platform facilitating companion care connections
A payment processor for companion care services
A provider of customer support and quality standards

WHAT WE ARE NOT:

A healthcare provider or medical service
A medical transportation provider (NEMT)
A caregiver service or home health agency
An employer of Personal Assistants
A Transportation Network Company (TNC) like rideshare services

Personal Assistants are independent contractors, not employees of AssisMonter. Our mission is to provide a safe, reliable, and compassionate platform for companion care while maintaining the highest standards of service quality and user satisfaction.

2. Customer Requirements

By requesting personal assistance services, you confirm that:

CUSTOMERS MUST BE ABLE TO:

Walk to and from vehicles independently (may use personal mobility aids like canes or walkers)
Enter and exit vehicles without physical assistance from Personal Assistant
Participate in activities independently
Communicate needs clearly

PERSONAL ASSISTANTS DO NOT:

Push wheelchairs or provide physical mobility support
Operate medical equipment or devices
Provide hands-on personal care (bathing, dressing, toileting)
Administer medications or medical treatments

We welcome customers with disabilities. Our services focus on companionship and non-physical assistance during daily activities.

3. Personal Assistant Role & Independent Contractor Status

AssisMonter Personal Assistants are independent contractors, not employees of AssisMonter. They operate their own businesses, provide their own vehicles, and are responsible for their own insurance, licensing, and compliance with local regulations.

As independent contractors, Personal Assistants:

Are self-employed and responsible for their own taxes
Provide their own vehicles, insurance, and equipment
Set their own schedules and work availability
Are not entitled to employee benefits or protections
Have the right to accept or decline service requests

Their services include:

Providing companionship and social support
Accompanying customers during shopping, appointments, airport trips, errands, and daily tasks
Offering light assistance such as:
- Loading or unloading shopping bags (≤ 25 lbs each)
- Verbal guidance and navigation support
- Opening doors and pushing shopping carts
- Waiting with customers during appointments
Providing courteous, patient, and professional companionship

3.5 Background Check Transparency

All Personal Assistants undergo a comprehensive background check, which includes:

✓ National criminal database search
✓ Sex offender registry check
✓ Motor vehicle records (MVR) review

Background checks have limitations and may not show:

Recent arrests (within 7 days)
Pending charges not yet adjudicated
Civil lawsuits or judgments
Financial history or credit information

We reject applicants with violent crimes, sex offenses, theft/fraud convictions, recent DUI, or serious moving violations. Background checks are updated annually.

While we conduct thorough screening, customers should use their own judgment when interacting with Personal Assistants. Report any concerns immediately to support@assismonter.com.

4. Personal Assistant Restrictions

AssisMonter Personal Assistants are not permitted to:

Push wheelchairs or provide physical assistance
Administer medications or medical treatments
Provide medical care, diagnosis, or treatment
Handle medical equipment or devices
Provide personal care services (bathing, dressing, etc.)

5. User Responsibilities

As a user of AssisMonter services, you agree to:

Provide accurate and complete information when booking services
Treat Personal Assistants with respect and courtesy
Follow all applicable laws and regulations
Not request services that violate these terms
Pay for services as agreed upon
Report any issues or concerns promptly
Maintain appropriate behavior during services

6. Service Conditions

All service requests must include accurate locations for assistance services.

Personal assistance services are only for users who can safely enter and exit the vehicle on their own.

Personal Assistants may request assistance from the user if needed for safety purposes.

For security and compliance, AssisMonter reserves the right to cancel a service if the conditions above are not met.

7. Liability & Disclaimer

As a companion care technology platform, AssisMonter operates as an intermediary service and does not directly provide companion care services. Our liability is limited to the operation of our technology platform.

IMPORTANT LEGAL DISTINCTION:

AssisMonter operates as a technology platform connecting customers with independent Personal Assistants. We do not employ Personal Assistants, do not provide services directly, and do not control how Personal Assistants perform their services. Personal Assistants are solely responsible for their actions, service quality, and compliance with laws.

By using our platform, you acknowledge that:

Personal Assistants are independent contractors, not our employees
We facilitate connections but do not provide services ourselves
We are not liable for Personal Assistants' actions or service quality
You enter into a direct service relationship with the Personal Assistant
Our liability is limited to the operation of our technology platform
AssisMonter is not a healthcare provider, transportation provider, or employer
All services are non-medical and non-emergency
Use of the app does not create a healthcare, caregiver, or employment relationship

8. Cancellation & Refusal

AssisMonter Personal Assistants may refuse service if:

The user appears unable to walk safely without support
The situation violates the terms of this agreement
There is a safety, legal, or ethical concern
The user requires medical assistance beyond our scope
The user is under the influence of drugs or alcohol
The user behaves inappropriately or poses a safety risk

9. Payment & Service Fees

All personal assistance services must be paid for through the AssisMonter app using approved payment methods.

Service fees may apply and will be clearly displayed before booking confirmation.

Prices are subject to change based on demand, distance, and service type. Users will be notified of any fare changes before booking.

10. Service State Requirements

Personal Assistants must provide services only in their designated service state as registered in their profile.

Service state matching ensures compliance with local regulations and provides users with Personal Assistants familiar with their area.

Personal Assistants may not provide services outside their registered service state without prior approval from AssisMonter.

Violation of service state restrictions may result in account suspension or termination.

11. Technology Platform & Business Model

AssisMonter operates as a companion care technology platform, not as a Transportation Network Company (TNC) or traditional transportation service provider.

Our business model:

We provide digital infrastructure and technology to connect independent Personal Assistants with users
We do not own, operate, or maintain any vehicles
We do not employ Personal Assistants or provide companion care services directly
We facilitate transactions and provide user support for our platform
We earn revenue through platform fees and service charges

Our platform connects users with independent Personal Assistants for companion care services. We do not provide transportation services.

12. Privacy & Data

AssisMonter collects and processes personal data in accordance with our Privacy Policy.

By using our service, you consent to the collection and use of your information for service provision, safety, and improvement purposes.

Location data is collected only during active services for safety and service quality purposes.

13. Updates

AssisMonter reserves the right to update these Terms of Service at any time. Users will be notified of significant changes through the app or email.

Continued use of the service after changes indicates acceptance of the new terms. It is the user's responsibility to review the updated terms regularly.

14. Intellectual Property

All content, features, and functionality of the AssisMonter platform, including but not limited to text, graphics, logos, software, and design elements, are owned by AssisMonter and are protected by copyright, trademark, and other intellectual property laws.

Users may not copy, reproduce, distribute, or create derivative works from any part of the platform without explicit written permission from AssisMonter.

15. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of Maryland.

Any disputes arising from these terms or the use of our services will be resolved in the courts of Prince George County, Maryland.
